OverShare® provides voice communication services, including but not limited to:
- Voice calling and forwarding.
- Voicemail recording and transcription.
- Voice greeting customization.
- Call recording and management.
- Phone number provisioning and management.
- Integration with Twilio communication services.
3. User Accounts
Account Creation
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You must be at least 18 years old to use this Service.
- One person or legal entity may not maintain more than one account without prior approval.
Account Security
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized use of your account.
- We reserve the right to suspend or terminate accounts that violate these terms.
4. Subscriptions and Payments
Subscription Plans
OverShare® offers various subscription tiers with different features and pricing. By subscribing, you agree to:
- Pay all fees associated with your chosen subscription plan.
- Automatic renewal unless cancelled before the renewal date.
- Potential price changes with 30 days' notice.
Payment Processing
- Payments are processed through Apple's in-app purchase system or other approved payment processors.
- You authorize us to charge your payment method for all fees.
- Failed payments may result in service suspension.
Refund Policy
- Refunds for subscriptions purchased through Apple are subject to Apple's refund policy and must be requested through Apple.
- For subscriptions purchased directly through OverShare®, refunds are handled on a case-by-case basis and are generally non-refundable.
- Pro-rated refunds are not available for partial subscription periods.

5. Phone Numbers and Communication
Phone Number Provisioning
- Phone numbers are provided through Twilio and subject to availability.
- You do not own the phone numbers; they are licensed for your use.
- We reserve the right to reclaim inactive or abusive phone numbers.
- Number portability may be available subject to carrier restrictions.
Acceptable Use
You agree NOT to use the Service for:
- Spam, robocalls, or unsolicited marketing (TCPA violations).
- Harassment, threats, or abusive behavior.
- Illegal activities or fraudulent purposes.
- Impersonation or misrepresentation.
- Bypassing telecommunications regulations.
6. Content and Recording
Your Content
- You retain ownership of voice recordings, greetings, and other content you create.
- You grant us a license to store, process, and transmit your content as necessary to provide the Service.
- You are responsible for ensuring you have the right to record and store all communications.
Recording Consent and Legal Compliance
Important: You are solely responsible for complying with all applicable laws regarding call recording, including obtaining necessary consent from all parties. Laws vary by jurisdiction, and some states and countries require all-party consent before recording.
Automated Announcement: The Service includes an automated "This call is being recorded" announcement at the start of recorded calls. However, you remain responsible for ensuring compliance with local recording laws in your jurisdiction.
Transcription Services
- Automated transcriptions are provided for convenience and may contain errors.
- We do not guarantee transcription accuracy.
- Transcriptions are processed by Twilio's automated systems and may utilize AI-powered speech recognition technology.
- Your voice data may be processed by third-party AI sub-processors for transcription purposes.
7. Privacy and Data Protection
Your privacy is important to us. Please review our Privacy Policy (below) for detailed information about how we collect, use, and protect your data.
8. Prohibited Activities
You may not:
- Reverse engineer, decompile, or attempt to extract source code.
- Use automated systems to access the Service without permission.
- Interfere with or disrupt the Service or servers.
- Attempt to gain unauthorized access to any systems or data.
- Remove or modify any proprietary notices or labels.
- Use the Service in violation of any applicable laws or regulations.
9. Service Modifications and Availability
- We reserve the right to modify or discontinue the Service with reasonable notice.
- We strive for 99.9% uptime but cannot guarantee uninterrupted service.
- Scheduled maintenance will be announced in advance when possible.

Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OverShare® SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Maximum Liability
Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless OverShare® and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any rights of another party.

Our Service integrates with third-party services including:
- Twilio: Voice communication infrastructure, call recording, and transcription services.
- Apple Sign-In: Authentication (if used).

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
Dispute Resolution
- Any disputes shall first be attempted to be resolved through good-faith negotiations.
- If negotiations fail, disputes shall be resolved through binding arbitration.
- Arbitration shall be conducted by a single arbitrator under the rules of the American Arbitration Association.
- You waive the right to participate in class action lawsuits.
